   An act to add Sections 19849.22 and 20687.2 to the Government
Code, relating to peace officers, and making an appropriation
therefor.



	LEGISLATIVE COUNSEL'S DIGEST


   SB 1910, Dunn.  State peace officer/firefighter supervisors.
   Existing law provides for management compensation incentives for
state employees to, among other things, enable the state to attract
and retain highly qualified managerial employees.
   This bill would make findings and declarations that a minimum
supervisory compensation differential is necessary to compensate
state peace officer/firefighter members who are supervisors within
the departments and boards of the Youth and Adult Correctional
Agency.  The bill would require the Department of Personnel
Administration to provide specified legislative committees with a
report, on or before March 31, 2001, regarding the adjustments
necessary to implement that differential and the impacts on the
budgets of the affected departments and boards.  The bill would
declare the Legislature's intent to consider funding those
adjustments in the Budget Act of 2001.
   Under the existing Public Employees' Retirement Law, the normal
rate of contribution for state peace officer/firefighter members is
8% of compensation in excess of $238 per month.
   This bill would decrease that rate for state peace
officer/firefighter members who are supervisors within the boards and
departments of the Youth and Adult Correctional Agency to 8% of
compensation in excess of $863 per month.  The bill would appropriate
$500,000 from the General Fund to the Director of Finance for
allocation by Executive order to the boards and departments affected
by this provision.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 19849.22 is added to the Government Code, to
read:
   19849.22.  The Legislature finds and declares the following:
   (a) If the state is to attract and retain a competent correction
workforce, there is a compelling need to adequately compensate state
peace officer/firefighter members who are supervisors.
   (b) A supervisory compensation differential is necessary to
compensate state peace officer/firefighter members who are
supervisors within the departments and boards of the Youth and Adult
Correctional Agency for the greater responsibility of accomplishing
correctional work through the direction of others.
   (c) For purposes of measuring the compensation differential
referred to in subdivision (b), the value of salaries and other
economic benefits shall be considered in calculating comparative
rates.
  SEC. 2.  Section 20687.2 is added to the Government Code, to read:

   20687.2.  Notwithstanding Section 20687, the normal rate of
contribution for state peace officer/firefighter members who are
supervisors within the boards and departments of the Youth and Adult
Correctional Agency for pay periods beginning after April 30, 2001,
shall be 8 percent of compensation in excess of eight hundred
sixty-three dollars ($863) per month paid those members.
  SEC. 3.  The Department of Personnel Administration shall provide
the fiscal committees of both houses of the Legislature and the Joint
Legislative Budget Committee with a report, on or before March 31,
2001, on the adjustments necessary to implement the provisions of
Section 19849.22 of the Government Code.  That report shall describe
the impacts of the recommended changes, after consideration of the
impacts of Section 2 of this act, on the budgets of the affected
departments and boards for the 2001-02 fiscal year.  It is the intent
of the Legislature to consider funding the adjustments necessary to
eliminate or reduce remaining compaction in the correction workforce
in the Budget Act of 2001.
  SEC. 4.  The sum of five hundred thousand dollars ($500,000) is
appropriated from the General Fund to the Director of Finance for
allocation by Executive order during the 2000-01 fiscal year to the
departments and boards affected by Section 2 of this act.
